Who is the controller
The controller of data you provide when contacting me through this website is Janusz Nosek. For data matters, write to kontakt@janusznosek.pl.
If we start working together, the party to the brokerage agreement and the controller of data processed to perform it is AN-JA sp. z o.o., registered office: Al. What data I process
This website has no contact form. You provide data yourself (name, email, phone, the content of your message) when you email me, write on WhatsApp or call. If we work together, this also includes data needed for the agreement and the transaction, such as identification data and property data.
Providing data is voluntary. Without it I cannot reply or sign an agreement with you.
Purposes and legal bases
- Replying to your enquiry and pre-contract talks: Art. 6(1)(b) GDPR (steps before entering into a contract) and Art. 6(1)(f) (legitimate interest in replying to messages).
- Entering into and performing the brokerage agreement: Art. 6(1)(b) GDPR.
- Legal obligations, including tax, accounting and a real estate broker's duties under Polish anti-money-laundering law: Art. 6(1)(c) GDPR.
- Establishing, pursuing and defending claims, including fee claims: Art. 6(1)(f) GDPR.
- Visit statistics (Google Analytics), only with your consent: Art. 6(1)(a) GDPR.
Who may receive data
Only those the service cannot work without:
- hosting, email and IT providers,
- Meta (WhatsApp), if you write on WhatsApp,
- Google, if you consent to statistics,
- when we work together: notaries, banks, cooperating agents (including the Agent Network model), accountants and lawyers, as far as the transaction requires,
- public authorities, where the law requires it.
Transfers outside the EEA
Google and Meta may process data in the USA, based on the EU-US Data Privacy Framework or standard contractual clauses approved by the European Commission.
How long I keep data
- Enquiry without cooperation: up to 12 months from our last contact.
- Agreement: for its term, then until claims become time-barred.
- Tax and accounting records: 5 years from the end of the tax year.
- Anti-money-laundering records: 5 years from the end of the cooperation or transaction.
Your rights
You have the right to access, rectify, erase and port your data, to restrict processing and to object. You can withdraw consent at any time. This does not affect processing carried out before withdrawal. You may also lodge a complaint with the Polish supervisory authority, Prezes Urzędu Ochrony Danych Osobowych (ul.
